The FAIB

Definition

The FAIB is the Federation of European and International Associations established in Belgium.  It has no political objectives and no profit-making intent.

Its purposes are:

1. To take and to pursue every initiative which encourages European and international associations to be established and to remain in Belgium.
2. To study, to further and to defend the interests – both moral and material – of its members, without being involved in their activities.  The FAIB represents its members to third parties and defends their interests, notably to all public and private bodies.
3. To obtain, by concerted action, official legal recognition of associations and the associative movement by Belgian, European and international authorities.
4. To help to obtain every possible measure likely to facilitate the activities of its members.
5. To assist its members in the organization of their activities, especially by setting up joint studies, administrative and auxiliary services, etc.
6. To keep its members informed of developments in legal and administrative spheres which affect them

History

The FAIB was founded in 1949 as an initiative of the leaders of the UIA who wished to draw the attention of official authorities to the existence in Belgium of international associations and to the need to facilitate their activities.

The FAIB has been presided over by great men of state, such as Paul Van Zeeland, Albert Lilar, Pierre Harmel and lately by André De Schutter, Honorary Ambassador, who hold the position for almost 17 years, wishing to promote the development of international life in Belgium.  While preserving the initials FAIB, in 2004 the Federation added to its name the word ‘European’ to emphasize the European character of the majority of its members.

Administration

The FAIB is directed by its General Assembly and managed by a Board of Directors composed of representatives of member associations.  The FAIB is mainly financed by the subscriptions of its members.

Members

The members of the FAIB are associations or organizations whose membership, purposes or activities have a truly European or international character and are non-profit-making.  The FAIB counts among its members a thoroughly diverse range of associations: professional federations, cultural and scientific associations, youth organizations, others with sporting, religious, or philanthropic interests, etc.

FAIB has four categories of members:

1. Full members: European and international organizations legally or effectively established in Belgium on a permanent basis or for the time being.
2. Associate members: people or corporate bodies who by their membership affirm their interest in the federation and offer their support.
3. Honorary members: persons on whom the General Assembly confers this title in recognition of their special competency or the distinguished service they have rendered to the Federation.
4. Supporting members: people or corporate bodies who support the Federation financially.

Achievements and activities

The FAIB has successfully pursued a variety of activities on behalf of European and international associations, for example:

• The creation, in 1983, with the co-operation of the Belgian government, of an International Association Centre (IAC), the MAI ( Maison des Associations Internationales), situated at 40 rue Washington, 1050 Brussels, with an extension at 1 rue Defacqz. The FAIB has its headquarters at the MAI.  The Centre houses the secretariats of several European and international associations and offers all modern facilities for the organization of meetings, seminars, conferences and receptions.
• The modification, in December 1954, of the law of October 25th 1919 governing international associations with scientific aims, in order to extend this law to international associations with philanthropic, religious, artistic and pedagogic aims.
• Close collaboration in the work of government services and with Parliament drawing up the new law of May 2nd 2002 on non-profit associations, international non-profit associations and foundations.

Within the limitations imposed by its resources and the priorities fixed by the members, the FAIB carries out the following activities:

• Following up the application of certain clauses of the law of May 2nd 2002.
• The study of legal problems and fiscal questions in general and in particular and continuing the regular series of socio-economic surveys on European and international associations founded in Belgium.
• Establishing and maintaining relationships with social partners in Belgium and with the services of the European Union.
• Establishing and maintaining relations with federations of European and international associations based in other countries.
• Organization of visits to towns and conference centres in all parts of the world.
• Publication of a quarterly newsletter “ FAIB NEWS” for members only and “FAIB NEWS FLASH” for non-members.

• Participation, at a special reduced rate, in the lunch debates, conferences and seminars organized with experts on topics of common interest: taxation, computerization, legal and economic questions, conference organization, administrative procedure for securing national and/or European subsidies, etc.
• Individual consultation and advice on all questions, whether specific or general.
• Access to IAC services – MAI, 40 rue Washington, 1050 Brussels – domiciliation, hire of offices and meeting rooms and use of computer equipment.
• Special rates for participation in FAIB activities and for access to IAC services.
• Preferential rates for certain publications.

How to become a member of the FAIB

Members of the FAIB are European and/or international organizations based in Belgium.  Membership of the FAIB as a full member is subject to the following conditions:

• Having a European or an international nature.
• Being founded on a permanent basis.
• Being without any intent of making profit.
• Having an honourable aim and pursuing this genuinely, in practice.
• Having a healthy financial situation, and being able to prove that the acquisition, management and use of the financial resources are honestly carried out.

An Admissions Committee examines the applications for membership.  In order to allow this Committee to study the applications submitted, associations applying are asked to send in the following documents:

• Statutes
• Names of the members of the Board of Directors
• A copy of the most recent financial report.
• A copy of the most recent activity report.

In addition the members of the Committee may make inquiries by contacting the persons involved and pose any further questions which they think appropriate.  The Committee reports to the Board of Directors, which makes a decision on the applications received.  An annual subscription is levied: the adaptation of the amount is decided by the General Assembly.
 

La FAIB asbl

Définition

La FAIB est la fédération des associations européennes et internationales établies en Belgique. Elle est dénuée de tout caractère politique  et ne poursuit aucun but lucratif.

Elle a pour objectifs:

1. de prendre et de promouvoir toute initiative tendant à favoriser l’établissement et le maintien en Belgique d’associations européennes et internationales.
2. d’étudier, de promouvoir et de défendre les intérêts collectifs - moraux et matériels -  de ses membres, sans s’immiscer dans leur activité propre.
3. La FAIB représente et défend les intérêts de ses membres vis-à-vis des tiers, notamment de tous les organismes publics ou  privés.
4. d’obtenir par l’action collective la reconnaissance statutaire officielle et représentative des associations et du mouvement associatif comme tel par les instances belges, européennes et internationales.
5. d’aider à obtenir toute mesure susceptible de faciliter à ses membres l’exercice de leurs activités.
6. d’assister ses membres dans l’organisation de leurs activités, notamment par l’établissement en commun d’organismes d’étude, de services administratifs et auxiliaires, etc.
7. d’informer ses membres des développements intervenus dans les domaines juridiques et administratifs qui les concernent.

Historique

La FAIB a été fondée en 1949 à l’initiative des dirigeants de l’Union des associations internationales qui voulurent sensibiliser les milieux officiels sur la présence en Belgique d’associations internationales et sur la nécessité de faciliter l’exercice de leurs activités.
La Fédération a été présidée par de grands hommes d’Etat, Paul Van Zeeland, Albert Lilar,  Pierre Harmel et récemment André De Schutter, Ambassadeur Honoraire, qui a rempli la fonction pendant 17 ans,  soucieux de favoriser le développement de la vie internationale en Belgique. Tout en retenant le sigle “FAIB”, la Fédération a, en 2004, ajouté à sa dénomination la mention “européenne” pour souligner l’identité européenne de la majorité de ses membres.

Administration

La FAIB est dirigée par son Assemblée générale et administrée par un Conseil d’administration composé de représentants des associations membres. La FAIB est essentiellement financée par les cotisations de ses membres.

Membres

Les membres de la FAIB sont des associations ou organisations permanentes dont la composition, l’objet ou l’activité revêtent un caractère véritablement européen et/ou international et non lucratif.
La FAIB compte parmi ses membres les associations les plus diverses: fédérations professionnelles, associations culturelles et scientifiques, organisations de jeunesse, de sports, religieuses, philanthropiques, etc.

La FAIB compte quatre catégories de membres:

1. Membres effectifs: organisations européennes et/ou internationales de droit ou de fait établies à demeure ou à temps en Belgique.
2. Membres associés: personnes physiques ou morales qui, par leur adhésion, témoignent leur intérêt à la fédération et lui apportent leur  appui.
3. Membres d’honneur: personnalités auxquelles l’assemblée générale confère ce titre en considération de leur haute compétence ou en reconnaissance  des services éminents  qu’ils ont rendus à la fédération.
4. Membres adhérents: personnes physiques ou morales qui apportent un soutien financier à la fédération.

Réalisations et actions.

La FAIB a mené à bien différentes actions dans l’intérêt des associations européennes et  internationales, par exemple :

• création en 1983, avec le concours du gouvernement belge, d’une Maison des Associations Internationales (MAI) située au n° 40, rue Washington, à 1050 Bruxelles, et dont l’extension se trouve au n° 1, rue Defacqz. La FAIB à son siège social à la MAI.  La maison  abrite le secrétariat de plusieurs associations européennes et  internationales et offre toutes les facilités modernes pour l’organisation de réunions, séminaires ,congrès et réceptions.
• modification en décembre 1954 de la loi du 25 octobre 1919 sur les associations internationales à but scientifique afin d’étendre cette loi aux associations internationales à but philanthropique, religieux, artistique et pédagogique.
• collaboration  étroite aux travaux des services gouvernementaux et du Parlement pour la mise au point de la nouvelle loi du 2 mai 2002 sur les associations sans but lucratif, les associations internationales sans but lucratif et les fondations.

Dans les limites de ses ressources et sous réserve des priorités fixées par ses membres, le FAIB poursuit les activités suivantes :

• le suivi de l’application de certaines  modalités de la loi du 2 mai 2002.
• l’étude des problèmes juridiques et fiscaux généraux et particuliers et la réalisation régulière d’enquêtes socio-économiques sur  les associations européennes et internationales établies en Belgique.
• l’établissement et le maintien de relations avec les partenaires sociaux en Belgique et avec les services de l’Union européenne.
• l’établissement et le maintien de relations  avec les fédérations d’associations européennes et internationales établies dans d’autres pays.
• la publication d’un bulletin d’information trimestriel «  FAIB NEWS » pour les membres et »FAIB NEWS FLASH » pour les non membres.

• participation aux visites de villes et centres de congrès dans le monde.

Comment devenir membre de la FAIB.

Les membres de la FAIB sont des organisations européennes et/ou internationales établies en Belgique.

L’affiliation à la FAIB en tant que membre effectif est possible aux conditions suivantes :

• avoir un caractère  européen et/ou international.
• être constitué de façon permanente.
• être dénué de tout caractère lucratif.
• avoir un objet honorable et  poursuivre effectivement celui-ci.
• avoir une situation financière saine, faire preuve d’honnêteté dans l’acquisition, la gestion et l’utilisation de leurs ressources financières.
• avoir des activités effectives documentées.

Un Comité d’admission examine les demandes d’affiliation. En vue de permettre à ce Comité d’étudier les candidatures reçues, il est demandé aux associations candidates de soumettre les documents suivants :

• statuts
• composition du Conseil d’administration.
• rapport financier le plus récent.
• rapport d’activités le plus récent.

En outre les membres du Comité peuvent s’informer par contacts personnels de toute question qui peut leur sembler utile. Le Comité fait rapport au Conseil d’administration qui décide de la suite à donner aux candidatures reçues.
Une cotisation annuelle est prévue : ce montant est modifié par l’Assemblée générale.
 

Het FAIB vzw

Omschrijving

Het FAIB is een federatie van europese en internationale verenigingen zonder winstoogmerk die gevestigd zijn in België.

De federatie is een niet politieke vereniging zonder enig winstoogmerk en heeft de volgende doelstellingen:

1. initiatieven nemen en ondersteunen die de vestiging en het behoud van europese en internationale verenigingen in België  bevorderen.
2. de gemeenschappelijke belangen – moreel en materiel – van zijn leden bestuderen, bevorderen en verdedigen zonder zich in hun activiteiten te mengen. Het FAIB vertegenwoordigt en verdedigt de belangen van zijn leden tegenover  derden, namelijk alle openbare of privé Organisaties.    
3. door collectief optreden, van de belgische, de europese en de internationale officiele instanties, het officieel statutaire en vertegenwoordigend statuut bekomen voor de verenigingen in het bijzonder en voor het verenigingsleven  in het algemeen.
4. maatregelen bekomen die de werkzaamheden van zijn leden vergemakkelijken.
5. steun verlenen aan de leden voor de organisatie van hun werkzaamheden, o.m. door het inrichten van gemeenschappelijke studieorganen, administratieve diensten, e.a.
6. zijn leden informeren over de recente  ontwikkelingen die hen aanbelangen op juridisch en administratief gebied.

Historiek.

Het FAIB werd opgericht in 1949 op initiatief van de bestuursleden van de Unie der Internationale Verenigingen-UAI- die de aandacht van de overheidskringen wilde vestigen op de aanwezigheid in België van internationale verenigingen en de noodzaak om het uitoefenen van hun activiteiten te ondersteunen.
De federatie werd voorgezeten door grote staatslieden, Paul Van Zeeland, Albert Lilar, Pierre Harmel en laatstleden door André De Schutter, Ere-Ambassadeur, die de functie bekleedde gedurende meeer dan 17 jaar,  die er allen naar streefden de ontwikkeling van het internationale leven in België te bevorderen. Om de europese identiteit van de meerderheid van zijn leden te bevestigen heeft de federatie in 2004 aan zijn  benaming de vermelding “europees” toegevoegd zonder evenwel zijn logo “FAIB” te wijzigen.

Administratie.

Het  FAIB wordt geleid door zijn Algemene Vergadering en bestuurd door de Raad van Bestuur die samengesteld is uit vertegenwoordigers van de verenigingen die lid zijn.
Het FAIB wordt hoofdzakelijk gefinancierd door de bijdragen van zijn leden.

Leden.

De leden van het FAIB zijn permanente verenigingen of organisaties waarvan de samenstelling, het doel of de activiteit een waarachtig europees en/of internationaal karakter heeft zonder winstgevend doel.
Het FAIB telt onder zijn leden de meest verscheidene verenigingen : beroepsverenigingen, kulturele en wetenschappelijke verenigingen, jeugd-, sport-religieuze en filantropische organisaties, enz.

Het FAIB heeft vier categoriën leden:

1. Effectieve leden: europese en/of internationale verenigingen met rechtspersoonlijkheid of feitelijke verenigingen permanent of tijdelijk in België gevestigd.
2. Geassociëerde leden: natuurlijke of rechtspersonen die door hun lidmaatschap getuigen van hun interesse voor de federatie en deze ondersteunen.
3. Ereleden: personaliteiten aan wie de algemene vergadering deze titel verleent  als eerbetoon voor hun bijzondere bekwaamheid of als erkenning voor de eminente diensten die ze aan de federatie hebben bewezen.
4. Aangesloten leden: natuurlijke of rechtspersonen die de federatie financiëel steunen.

Verwezenlijkingen en activiteiten

Het FAIB heeft reeds veel verwezenlijkt ten bate van de europese en internationale verenigingen :

• de oprichting in 1983 met de steun van de belgische regering, van een Centrum voor Internationale Verenigingen (MAI) gevestigd in de Washingtonstraat, 40, 1050 Brussel met een uitbreiding in de Defacqzstraat, 1. Het FAIB heeft zijn zetel in het MAI. Het centrum biedt onderdak aan het secretariaat van verscheidene europese en internationale verenigingen en beschikt over alle moderne voorzieningen voor het organiseren van vergaderingen, seminaries en congressen.
• de wijziging in december 1954 van de wet van 25 october 1919 tot verlening van rechtspersoonlijkheid aan de internationale verenigingen met wetenschappelijk doel teneinde deze wet uit te breiden tot de internationale verenigingen met menslievend, godsdienstig,wetenschappelijk, artistiek of pedagogisch doel.
• de totstandkoming, dankzij een nauwe samenwerking met de regerings- en parlementaire diensten, van de nieuwe wet van 2 mei 2002 betreffende de verenigingen zonder winstoogmerk, de internationale verenigingen zonder winstoogmerk en de stichtingen.

Binnen de beperkingen van zijn mogelijkheden en onder voorbehoud van de prioriteiten bepaald door zijn leden, voert het FAIB de volgende activiteiten uit :

• de opvolging van de toepassing van bepaalde modaliteiten van de wet van 2 mei 2002.
• het bestuderen van algemene en specifieke juridische en fiscale problemen en de regelmatige uitvoering van socio-economische enquêtes omtrent de europese en internationale in België gevestigde verenigingen.
• het aanknopen en het behoud van contacten met de sociale partners in België en met de diensten van de Europese unie.
• het aanknopen en het behoud van contacten met de federaties van europese en internationale in andere landen gevestigde verenigingen.
• de publicatie van een driemaandelijks informatieblad  «  FAIB NEWS » alleen voor leden en «  FAIB NEWS FLASH » voor niet leden.

Voordelen voorbehouden aan de leden van het FAIB.

• kosteloze raadpleging langs electronische weg van de « Practical Guide for the use of European and International Associations established in Belgium ».
• FAIB NEWS: trimestriele publicatie.
• deelname aan voordeeltarieven aan de debat-lunches, lezingen en seminaries gelied door deskundigen over onderwerpen van gemeenschappelijk en actueel belang : fiscaliteit, informatisatie, juridische en economische problemen, organisatie van congressen, administratieve procedures voor het bekomen van nationale en/of europese subsidies, enz.
• individuele raadpleging en raadgeving voor alle specifieke en algemene vragen.
• toegang, aan voorkeurtarieven, tot de diensten van het MAI – Centrum voor Internationale Verenigingen, in de Washingtonstraat, 40, 1050 Brussel – domiciliatie, huur van burelen en vergaderzalen en gebruik van de informatica.
• mogelijkheid om congrescentra wereldwijd te bezoeken.
• voorkeurtarieven voor enkele publicaties en magazines.

Voorwaarden om lid te worden van het FAIB.

De leden van het FAIB zijn europese en/of internationale in België gevestigde verenigingen.

Om effectief lid te worden moeten de volgende voorwaarden worden vervuld :

• een europees en/of internationaal karakter hebben.
• een permanente vereniging zijn.
• geen enkel winstoogmerk hebben.
• een eerbaar  doel hebben en dit effectief nastreven.
• een gezonde financiële situatie hebben, blijk geven van eerlijkheid in het verwerven, beheren en gebruiken van zijn financiële middelen.
• bewijs leveren van effectieve activiteiten.

Een toelatingscomité bestudeert de aanvragen voor lidmaatschap. Teneinde dit comité toe te laten het dossier te bestuderen wordt aan de kandidaatverenigingen gevraagd de volgende documenten te bezorgen :

• statuten.
• samenstelling van de Raad van Bestuur.
• het jongste financiëel rapport.
• het jongste activiteitenrapport.

De leden van het Comité hebben bovendien de toelating om zich door persoonlijke contacten verder te informeren omtrent alle vragen die hen nuttig blijken. Het Comité rapporteert aan de Raad van Bestuur die op basis hiervan een beslissing neemt.
Een jaarlijkse ledenbijdrage, die door de algemene vergadering wordt aangepast, is voorzien.  
 

Die FAIB VoE

Definition

Die FAIB ist der Verband der in Belgien niedergelassenen Europäischen und Internationalen Vereinigungen. Er ist politisch unabhängig und arbeitet ohne Gewinnzweck.

Ziel der FAIB ist es:

1. alle Initiativen zu ergreifen und zu unterstützen, die der Einrichtung und dem Fortbestehen europäischer und internationaler Vereinigungen in Belgien förderlich sind.
2. die gemeinsamen – moralischen und materiellen – Interessen ihrer Mitglieder zu untersuchen, zu fördern und zu verteidigen, ohne sich in deren Aktivitäten einzumischen. Die FAIB vertritt und verteidigt gegenüber Dritten, insbesondere bei öffentlichen und privaten Stellen, die Interessen ihrer    Mitglieder.
3. gemeinsam zu handeln, damit die belgischen, europäischen und internationalen Instanzen den offiziellen Status und den repräsentativen Charakter der Vereinigungen und die Verbandsbewegung als solche anerkennen.
4. zu helfen, alle möglichen Maßnahmen zu erreichen, die ihren Mitgliedern die Ausübung ihrer Tätigkeiten erleichtern können.
5. ihre Mitglieder bei der Organisation ihrer Tätigkeiten, insbesondere durch die Schaffung gemeinsamer Forschungseinrichtungen, Verwaltungs- und Hilfsdienste usw., zu unterstützen.
6. ihre Mitglieder über gesetzliche und administrative Entwicklungen, die sie betreffen, zu unterrichten.

Entstehung und Entwicklung

Die FAIB wurde 1949 auf Initiative der Verantwortlichen der Union der Internationalen Verbände gegründet, die die offiziellen Kreise auf die Präsenz internationaler Vereinigungen in Belgien und auf die Notwendigkeit, die Ausübung ihrer Aktivitäten zu erleichtern, aufmerksam machen wollten.
Die Führung des Verbandes hat in den Händen großer Staatsmänner gelegen – Paul Van Zeeland, Albert Lilar, Pierre Harmel und letztens  André De Schutter, Ehrenbotschafter, der diese Stelle fast 17 Jahre bekleidet hat, – die sich darum bemüht haben, die Entwicklung des internationalen Lebens in Belgien zu fördern. 2004 hat der Verband seinen Namen um den Begriff „europäisch“ erweitert, um die europäische Identität der meisten ihrer Mitglieder zu unterstreichen, wobei die Abkürzung FAIB jedoch beibehalten wurde.

Verwaltung

Die FAIB wird von ihrer Generalversammlung geleitet und von einem Verwaltungsrat, der sich aus Vertretern der Mitgliedsvereinigungen zusammensetzt, verwaltet. Die FAIB wird hauptsächlich durch die Mitgliedsbeiträge ihrer Mitglieder finanziert.

Mitglieder

Die Mitglieder der FAIB sind ständige Vereinigungen oder Organisationen, deren Zusammensetzung, Ziele oder Aktivitäten eindeutig europäischer bzw. internationaler Natur sind und keinen lukrativen Charakter haben.
Zu den Mitgliedern der FAIB gehören die unterschiedlichsten Vereinigungen: Berufsverbände, kulturelle und wissenschaftliche Zusammenschlüsse, Jugend- und Sportorganisationen, religiöse und philanthropische Vereinigungen usw.

Die Mitglieder der FAIB werden in vier Kategorien unterteilt:

1. Effektive Mitglieder: europäische und internationale Organisationen, die von Rechts wegen oder tatsächlich auf Dauer oder auf Zeit in Belgien niedergelassen sind.
2. Assoziierte Mitglieder: natürliche oder juristische Personen, die durch ihren Beitritt ihr Interesse am Verband bekunden und diesen unterstützen.
3. Ehrenmitglieder: Persönlichkeiten, denen die Generalversammlung aufgrund ihrer außergewöhnlichen Kompetenz oder in Anerkennung außerordentlicher Dienste, die sie dem Verband erwiesen haben, diesen Titel verleiht.
4. Anhänger-Mitglieder: natürliche oder juristische Personen, die den Verband finanziell unterstützen.

Erreichtes und derzeitige Aktivitäten.

Die FAIB hat im Interesse der europäischen und internationalen Vereinigungen viel erreicht, darunter:

• 1983 mit Unterstützung der belgischen Regierung Gründung des Hauses der Internationalen Verbände (MAI) in der rue Washington 40 in 1050 Brüssel (Ixelles). Ein Nebengebäude befindet sich in der rue Defacqz 1. Die FAIB hat ihren Sitz im Haus der Internationalen Verbände, das daneben auch die Sekretariate mehrerer europäischer und internationaler Vereinigungen beherbergt und über alle modernen Einrichtungen verfügt, um dort Sitzungen, Seminare und Kongresse organisieren zu können.
• Im Dezember 1954 Änderung des Gesetzes vom 25. Oktober 1919 über internationale Vereinigungen mit wissenschaftlicher Zielsetzung, wodurch das Gesetz auf internationale Vereinigungen mit philanthropischer, religiöser, künstlerischer und pädagogischer Zielsetzung ausgeweitet wurde.
• Enge Zusammenarbeit mit den Diensten der Regierung und des Parlaments zur Ausarbeitung des neuen Gesetzes vom 2. Mai 2002 über die Vereinigungen ohne Gewinnerzielungsabsicht, die internationalen Vereinigungen ohne Gewinnerzielungsabsicht und die Stiftungen.

Im Rahmen ihrer Möglichkeiten und vorbehaltlich der von ihren Mitgliedern gesteckten vorrangigen Ziele umfasst der Tätigkeitsbereich der FAIB:

• Überwachung der Anwendung einiger Modalitäten des Gesetzes vom 2. Mai 2002.
• Untersuchung rechtlicher und steuerlicher Probleme im Allgemeinen und im Besonderen sowie regelmäßige Durchführung sozioökonomischer Erhebungen über in Belgien niedergelassene europäische und internationale Vereinigungen.
• Aufnahme und Aufrechterhaltung von Beziehungen mit den Sozialpartnern in Belgien und den Diensten der Europäischen Union.
• Aufnahme und Aufrechterhaltung von Beziehungen mit europäischen und internationalen Vereinigungsverbänden in anderen Ländern.
• Organisation von Besuchen von Städten und Kongresszentren in der ganzen Welt.
• Veröffentlichung des vierteljährlichen Informationsberichtes“ FAIB NEWS“ für Mitglieder und“ FAIB NEWS FLASH“ für Nichtmitglieder.

• Teilnahme an Arbeitsessen, Konferenzen und Seminaren zum Vorzugspreis. Bei diesen Veranstaltungen werden, unter Mitwirkung von Experten, Themen von allgemeinem Interesse behandelt: steuerrechtliche Fragen, Informationstechnologie, rechtliche und wirtschaftliche Probleme, Organisation von Kongressen, notwendige Verwaltungsverfahren zum Erhalt nationaler bzw. europäischer Subventionen usw.
• Individuelle Beratung und Ratschläge bei spezifischen oder allgemeinen Fragen.
• Zugang zu den Diensten des Hauses der Internationalen Verbände in der rue Washington, 40 in 1050 Brüssel (Ixelles) – Domizilierung, Anmietung von Büroräumen und Sitzungssälen sowie Nutzung der EDV-Ausstattung.
• Sonderkonditionen für die Teilnahme an Aktivitäten des Verbandes und für den Zugang zu den Diensten des Hauses der Internationalen Verbände.
• Vorzugskonditionen für einige Veröffentlichungen.

Beitritt zur FAIB.

Bei den Mitgliedern der FAIB handelt es sich um in Belgien niedergelassene europäische bzw. internationale Organisationen.

Ein Beitritt zur FAIB als effektives Mitglied ist unter den folgenden Voraussetzungen möglich. Die sich bewerbende Vereinigung muss

• einen europäischen bzw. internationalen Charakter haben.
• eine ständige Vereinigung sein.
• gemeinnützig sein.
• ein ehrenhaftes Ziel haben und dieses auch wirklich verfolgen.
• finanziell gesund sein und bei der Anschaffung, Verwaltung und Verwendung ihrer finanziellen Mittel korrekt vorgehen.
• Aktivitäten nachweisen können.

Die Beitrittsgesuche werden von einem Zulassungsausschuss geprüft. Damit dieser Ausschuss die eingegangenen Gesuche prüfen kann, müssen die sich bewerbenden Vereinigungen folgende Unterlagen einreichen:

• Satzung
• Zusammensetzung des Verwaltungsrates.
• aktuellster Finanzbericht.
• aktuellster Tätigkeitsbericht.

Außerdem können sich die Mitglieder des Ausschusses durch persönliche Kontakte über alle Fragen informieren, die ihnen nützlich erscheinen. Der Ausschuss erstattet dem Verwaltungsrat, der über die eingegangenen Gesuche entscheidet, Bericht.
Ein jährlich zu zahlender Mitgliedsbeitrag ist vorgesehen. Über die Höhe dieses Mitgliedsbeitrages entscheidet die Generalversammlung.
 

Fédération des associations Européennes et internationales etablies en Belgique - Statuts

Statuts adoptés par l'Assemblée générale extraordinaire du 14 décembre 2004.

TITRE 1 DENOMINATION ET SIEGE

Article 1 - L'association, constituée en association sans but lucratif conformément a la Loi du 27 juin 1921, a pour dénomination : - en français : Fédération des Associations Européennes et Internationales établies en Belgique - en néerlandais : Verbond van Europese en Internationale in België gevestigde Verenigingen; - en allemand : Verband der in Belgien niedergelassenen Europäischen und Internationalen Vereinigungen - en anglais : Federation of European and International Associations established in Belgium. Le sigle FAIB sera utilisé dans les quatre langues. Sous une nouvelle dénomination, la FAIB reprend tous les droits et obligations de la Fédération des associations internationales établies en Belgique (MB 23/09/1950)

Article 2 - L'association a son siège social dans la Région de Bruxelles Capitale. Il est à présent rue Washington 40, 1050 Bruxelles à la Maison des Associations internationales (MAI), dans l'arrondissement judiciaire de Bruxelles. Il peut être transféré à toute autre adresse par simple décision du conseil d'administration.

Article 3 - Par décision du conseil d'administration, l'association peut établir tous bureaux, sections, représentations et correspondances, tant permanents que temporaires, aussi bien en Belgique qu'à l'étranger.

TITRE II - BUTS

Article 4 - La FAIB est une association des associations européennes et internationales établies en Belgique. Elle est dénuée de tout caractère politique et ne poursuit aucun but lucratif. Elle a pour buts :

1° d'étudier, de promouvoir et de défendre les intérêts collectifs - moraux et matériels - de ses membres, sans s'immiscer dans leur activité propre. La FAIB représente ses membres vis-à-vis des tiers, notamment de tous organismes publics ou privés, pour défendre leurs intérêts généraux.

2° d'obtenir toute disposition, de prendre et de promouvoir toute initiative tendant à favoriser l'établissement et le maintien en Belgique d'associations européennes et internationales.

3° d'obtenir et de promouvoir par l'action collective la reconnaissance statutaire officielle et représentative du mouvement associatif comme tel et des associations par les instances européennes et internationales et d'aider à obtenir toute mesure susceptible de faciliter à ses membres l'exercice de leurs activités

4° d'assister ses membres effectifs dans l'organisation de leurs activités, notamment par l'établissement en commun d'organismes d'étude, de services administratifs et auxiliaires ; l'aménagement et l'équipement de locaux; etc.

TITRE III - MEMBRES

Article 5 - 1° Membres effectifs : organisations sans but lucratif de droit ou de fait dont la composition, l 'objet ou l'activité revêt un caractère européen et/ou international et qui sont établies à demeure ou à temps en Belgique. Le nombre de ces membres ne peut être inférieur à 3.

2° Membres associés : personnes physiques ou morales qui, par leur adhésion, témoignent leur intérêt à l'association et lui apportent leur appui.

3° Membres d'honneur : personnalités auxquelles l'assemblée générale confère ce titre en considération de leur haute compétence ou en reconnaissance des services éminents qu'ils ont rendus a l'association

4° Membres adhérents : personnes physiques ou morales qui apportent un soutien a l'association.

Article 6 - L'admission en tant que membre fait l'objet d'une décision du conseil d'administration. Tout candidat dont la demande d'admission est rejetée par le conseil d'administration peut faire appel de cette décision devant l'assemblée générale.

Article 7 - Les membres effectifs sont redevables d'une cotisation annuelle, dont le montant est fixé par l'assemblée générale. Ce montant ne peut être supérieur à 10.000 Euro.

Article 8 - Tout membre de l'association peut en tout temps se retirer par un écrit signifié au président. Une telle démission ne deviendra effective qu'à l'issue de l'exercice social au cours duquel elle aura été signifiée.

Article 9 - Sur proposition du conseil d'administration, un membre peut être exclu par l'assemblée générale statuant à la majorité des deux tiers des membres présents ou représentés. Un membre ne peut être exclu qu'après avoir été informé des raisons motivant son exclusion, au moins trois mois avant la date de la réunion de l'assemblée générale appelée à se prononcer et après avoir eu l'occasion de présenter sa défense devant l'assemblée.

Article 10 - Le membre démissionnaire ou exclu, ainsi que les ayants droit du membre dissous ou décédé, n'ont aucun droit sur le fonds social.

TITRE IV - ORGANES DE LA FEDERATION

A. Assemblée générale

Article 11 - L'assemblée générale se compose de tous les membres effectifs ; elle est investie de tous les pouvoirs permettant de réaliser les buts de l'association.

Article 12 - L'assemblée générale se réunit au moins une fois par an, au lieu et à la date déterminés par le conseil d'administration. Une assemblée générale sera convoquée à titre extraordinaire soit a l'initiative du conseil d'administration, soit à la requête écrite d'au moins un tiers des membres effectifs. La convocation aux assemblées générales est adressée par courrier ordinaire ou électronique aux membres effectifs par le secrétaire général - ou le cas échéant par un autre administrateur délégué à cet effet - au moins deux semaines à l'avance. Les autres membres peuvent également être convoqués. Les membres effectifs seront représentés à l'assemblée générale par leur président, leur secrétaire général, leur directeur ou par une autre personne déléguée à cet effet. Chaque membre effectif de l'association peut se faire représenter à l'assemblée générale par un autre membre effectif.

Article 13 - A l'assemblée générale, les membres effectifs ont voix délibérative ; les autres membres ont voix consultative.

Article 14 - Sauf disposition contraire des statuts, l'assemblée générale statue à la majorité simple des membres effectifs présents ou représentés. En cas de parité de voix, la voix du président est prépondérante. Les résolutions de l'assemblée générale sont portées à la connaissance des membres par correspondance ordinaire ou électronique et à la connaissance des tiers sur demande de leur part.

B. Conseil d'administration

Article 15 - L'association est administrée par un conseil d'administration agissant collégialement, composé de sept personnes au moins. Les administrateurs sont élus par l'assemblée générale sur proposition du conseil d'administration; les administrateurs élus peuvent coopter d'autres administrateurs, pour pourvoir à un siège vacant. Le mandat des administrateurs est de quatre ans. Il est renouvelable. L’administrateur absent à trois réunions du conseil d'un exercice sans avoir donné mandat à un autre administrateur pour y être représenté, est considéré comme démissionnaire.

Article 16 - Le conseil d'administration élit parmi ses membres un président, un ou plusieurs vice-présidents, un secrétaire général et un trésorier. Leur mandat a la même durée que leur mandat de membre du conseil d'administration. Ils sont rééligibles. A l'initiative du président, ces administrateurs peuvent se réunir en comité restreint pour examiner des affaires courantes et préparer les réunions du conseil d'administration.

Article 17 - Le conseil d'administration se réunit aux lieux et dates qu'il détermine. Chaque administrateur peut se faire représenter aux réunions par un autre administrateur. Aucun administrateur ne peut être porteur de plus d'une procuration. Le conseil d'administration ne peut statuer valablement que si la moitié au moins des administrateurs est présente ou représentée et si trois d'entre eux au moins sont présents. Sauf disposition contraire des statuts, le conseil d'administration statue à la majorité simple des membres présents ou représentés. En cas de parité des voix, la voix du président est prépondérante. Lorsqu'il l'estime nécessaire ou à la demande d'un administrateur, le président peut inviter, à une réunion du conseil d'administration, une personne ne faisant pas partie du conseil d'administration. Cette personne n'aura aucun droit de vote.

Article 18 - Le conseil d'administration a les pouvoirs les plus étendus pour l'administration de l'association. Tout ce qui n'est pas réservé par la loi ou les statuts à l'assemblée générale, est de la compétence du conseil d'administration. Le conseil d'administration peut déléguer des pouvoirs à un ou plusieurs de ses membres, ou à un tiers.

Article 19 - Dans les actes judiciaires et extrajudiciaires, la Fédération est représentée par deux administrateurs agissant conjointement.

TITRE V - BUDGET ET COMPTES

Article 20 - Le conseil d'administration soumet à l'approbation de l'assemblée générale les comptes de recettes et de dépenses de l'exercice écoulé -- de même que le bilan établi à la fin de l'exercice écoulé - Le conseil d'administration soumet également à l'approbation de l'assemblée générale, le budget de l'exercice suivant. L'exercice social commence le premier janvier de chaque année pour se terminer le trente et un décembre.

TITRE VI -GESTION JOURNALIERE ET MANDATAIRES SPECIAUX

Article 21 - Le conseil d'administration peut confier tout ou partie de la gestion journalière de l'association ou des missions particulières à toute personne de son choix.

Article 22 - Les représentants généraux et les délégués à la gestion journalière peuvent en faire autant dans le cadre des pouvoirs qui leur sont attribués.

TITRE VII - DISSOLUTION ET LIQUIDATION

Article 23 - L'assemblée générale peut prononcer la dissolution de l'association à la majorité des quatre cinquièmes des voix des membres présents ou représentés et elle nomme un ou des liquidateurs. Apres avoir soldé toutes les dettes de l'association dissoute, le liquidateur fera apport à titre gratuit de l'actif social à une ou plusieurs personnes morales sans but lucratif dont le ou les buts sociaux sont similaires à ceux de l'association dissoute.

TITRE VIII - DISPOSITIONS GENERALE

Article 24 - Tout ce qui n'est pas prévu explicitement dans les présents statuts est réglé par la loi. A défaut de règles énoncées dans la loi, prévaudront les dispositions du droit commun, le règlement d'ordre intérieur et les usages.

BELGIUM AND INTERNATIONAL ASSOCIATIONS: FAIB Survey 2007 -  2008 (published in January 2009)
INCREASING ECONOMIC IMPORTANCE

The President of the FAIB – Federation of European and International Associations established in Belgium, Mr André De Schutter, reported the results of the most recent five-yearly socio-economic survey carried out in 2008 by the Federation among its members. According to statistics published by the Union of International Associations (UIA), the number of European and international associations established in Belgium continues to increase: Belgium and Brussels rank high in the list of countries and cities in the world which host international associations.

The principal trends of the survey carried out in 1997 were confirmed, and indicate the growing socio-economic importance of the international association movement for the host country. European associations (with members in Europe) represent 66% of the total; the other associations are fully international. The majority of associations have their headquarters in the Région de Bruxelles Capitale: 85% are based in the Brussel-Capital region compared with 78% in 1997.

As far as employment in international associations is concerned, extrapolation from the figures from international associations established in Belgium shows the following:

Belgian citizens: 4.563 full time, 321 part time and 173 self-employed: total 5.057
EU citizens: 4.439 full time, 337 part time and 126 self-employed: total 4.901
Non-EU citizens: 272 full time, 8 part time and 16 self-employed: total 296
Total 9.720 full time, 773 part time and 321: total 10.814

The figures indicate an increase of 32% in the jobs created by international associations in the period between 1997 and 2008.

As to the income of these associations, it appears that 84% comes from countries outside Belgium, 11% from Belgium, and that 5% results from subsidies and donations. The majority, 83%, of these funds are spent in Belgium to cover the costs of administration and of employing personnel. In addition to this direct income, the economic benefit from visits and meetings organized in Belgium should be taken into account:

32% of visitors stay one day, compared with 42% in 1997
41% of visitors stay overnight, compared with 40% in 1997
18% of visitors stay 2-3 days and nights, compared with 12% in 1997
9% of visitors stay more than 3 days and nights, compared with 6% in 1997
By extrapolating these figures to cover all the international associations established in Belgium, one can deduce that their budget amounts to 1.640.257.898 Euro per year, compared with 911.008 Euro in 1997, and that 83% of that budget is spent in Belgium.

In 2007,  95% of visitors are from the E.U. and European countries and 5% from outside Europe.

With this survey, we wish to impress upon the federal, regional and local authorities in our country the importance, both economic and cultural, of international associations.

The FAIB devotes all its efforts to this task. It is important that the specific qualities of the international association sector should be recognized: associations should be welcomed and greeted with simplified legislation, instead of the battery of administrative constraints which are difficult to understand, and the constantly changing legislation to which they are subject. Positive development in this sector is in the interests of us all.

Admission of members

Article 5 of the statutes of the FAIB states that the Federation can admit as full members:

• associations, institutions and other organisations which have a membership, an objective or an activity of an international nature
• and which have their foundation in Belgium

In the context of article 5, the following rules apply.

To become and to remain a member, an international association is required

• to have an international nature
• to be constituted on a permanent basis
• to be totally without intentions of making a profit
• to possess an honourable objective – and to pursue this objective and not another under cover of the objective declared in its statutes
• to have a stable financial structure, and to be able to prove the honest acquisition, management and use of its financial resources
• to pursue the declared activities in practice and not simply to exist in name only

An Admissions Committee is charged with examining the extent to which an applicant association answers these requirements.  In order to allow this Committee to study the applications fully, associations applying for membership should submit the following documents:

• their statutes
• the names of the current members of the Board of Directors
• the most recent financial report
• the most recent report of activities carried out

In addition the members of the Admissions Committee may pose further questions which seem to them relevant.

The Admissions Committee reports to the Board of Directors, which, in accordance with article 6 of the statutes, has the responsibility of making a decision on the result of the application.

In accordance with the same article 6, any association whose application is rejected by the Board of Directors has the right of appeal against the decision to the General Assembly.

Article 8 of the statutes of the FAIB states that 'any member of the  association may at any time resign by sending a signed letter to the  President.  A resignation made in this way only becomes effective at the  end of the financial year in which the resignation was notified.'

L'article 5 des statuts de la FAIB précise que la Fédération peut admettre en tant que membres effectifs :

• les associations, institutions et autres organisations qui ont une composition, un objet ou une activité de caractère international
• et qui sont établies en Belgique.

Dans le contexte de cet article 5, les règles suivantes sont d'application.

L'acquisition et le maintien de la qualité de membre requièrent des associations internationales qu'elles :

• aient un caractère international
• constituent des organisations permanentes
• soient dénuées de tout caractère lucratif
• aient un objet honorable - et poursuivent effectivement celui-ci et non un autre sous le couvert de l'objet prévu par leurs statuts
• aient une situation financière saine, et fassent preuve d'honnêteté dans l'acquisition, la gestion et l'utilisation de leurs ressources financières
• aient des activités effectives et ne se contentent pas simplement d'exister.

Un Comité d'Admission a pour tâche d'examiner dans quelle mesure les associations répondent à ces conditions. En vue de permettre à ce Comité d'étudier les candidatures reçues, il est demandé aux associations candidates de lui soumettre :

• leurs statuts
• la composition actuelle du Conseil d'Administration
• le rapport financier le plus récent
• le rapport d'activités le plus récent

En outre les membres du Comité d'Admission s'informent par contacts personnels de toute question qui peut leur sembler utile.

Le Comité d'Admission fait rapport au Conseil d’administration auquel, aux termes de l'article 6 des statuts, il incombe de prendre une décision quant à la suite à donner aux candidatures reçues.

Aux termes du même article, les associations dont la candidature est rejetée par le Conseil d’administration ont le droit de faire appel de cette décision devant l'Assemblée Générale.

L'article 8 des statuts de la FAIB précise que: "tout membre de l'association peut en tout temps se retirer par un écrit signifié au président. Une telle démission ne deviendra effective qu'à l'issue de l'exercice social au cours duquel elle aura été signifiée".

Aanvaarding van leden

Artikel 5 van de statuten van het FAIB bepaalt wie de Federatie mag aanvaarden als effectieve leden;

• verenigingen, instituten en andere organisaties waarvan de samenstelling, de doelstelling of de  aktiviteiten een internationaal karakter hebben.
• gevestigd zijn in België.

In het kader van dit artikel 5, zijn volgende regels zijn van toepassing.

Het verwerven en behouden van het lidmaatschap  vereisen van de internationale verenigingen dat zij :

• een internationaal karakter hebben
• samengesteld zijn uit permanente organisaties
• geen  winstgevend doel hebben
• een eerbaar doel hebben – en dit effectief nastreven -  en geen ander onder de dekmantel van het vooropgestelde  doel voorzien in hun statuten.
• een gezonde financiële toestand hebben en het bewijs leveren van eerlijkheid bij het verwerven, beheren en gebruik van hun financiële middelen.
• het bewijs leveren van effectieve aktiviteiten en zich er niet alleen mee vergenoegen “ te bestaan”.

Een Comité voor de aanvaarding van nieuwe leden heeft als opdracht na te gaan in welke mate de verenigingen beantwoorden aan deze voorwaarden. Teneinde dit Comité toe te laten de ontvangen kandidaturen te bestuderen , wordt aan de kandidaten verzocht de volgende documenten voor te leggen :

• de statuten
• de huidig samenstelling van de Raad van Bestuur
• het meest recente  financieel rapport
• het meest recente aktiviteitenrapport

Bovendien informeren de leden van dit Comité zich onderling door persoonlijke contacten omtrent elke vraag die hen nuttig lijkt.

Het Comité rapporteert aan het Directiecomité aan dewelke het volgens artikel 6 van de statuten toekomt een beslissing te nemen  omtrent  het gevolg dat aan de ontvangen kandidaturen moet gegeven worden.

Volgens hetzelfde artikel, hebben de verenigingen wiens kandidatuur is verworpen door het Directiecomité, het recht om deze beslissing aan te vechten voor de Algemene Vergadering.

Artikel 8 van de statuten van het FAIB preciseert  dat : “ieder lid van de vereniging mag op ieder moment ontslag nemen door middel van een aangetekend schrijven aan de voorzitter. Het ontslag wordt maar effectief op het einde van het werkjaar tijdens dewelke het werd aangetekend”.
